DMCA & Copyright Policy

Octaned respects intellectual property. If you believe content on the platform infringes a copyright you own or control, here's how to file a takedown notice and how we respond.

Octaned operates under the safe-harbor provisions of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). We promptly respond to clear and complete notices of alleged copyright infringement.

1. Filing a notice

Send written notice to our designated agent at dmca@octaned.us. Your notice must include:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing and where it is located on Octaned (URL, listing ID, document name).
  4. Your name, mailing address, telephone number, and email.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

2. What happens next

  • We review the notice within a reasonable time — typically 1–3 business days.
  • If the notice is complete and the claim appears valid, we'll remove or disable access to the disputed content and notify the user who posted it.
  • We'll forward your notice (including your contact information) to the user who posted the content, as required by law.

3. Counter-notice

If your content was removed and you believe the removal was a mistake or misidentification, you may submit a counter-notice. Send it to dmca@octaned.us containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the URL or location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, mailing address, telephone number, email, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where you live (or, if outside the U.S., the District of Delaware), and that you will accept service of process from the original complaining party.

If we receive a valid counter-notice we will, after the period required by 17 U.S.C. § 512(g), restore the content unless the original complainant has initiated court action.

4. Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

5. Misrepresentations

Knowingly material misrepresentation in either a notice or counter-notice may make the issuer liable for damages under the DMCA, including costs and attorneys' fees.
