Privacy Policy

A discreet marketplace only works if you can trust how your information is handled. This page explains what Octaned collects, why, and what we do with it.

This policy applies to octaned.us and any related services operated by Octaned (“we”, us”). By using the platform you agree to the practices described here.

1. Information we collect

1.1 Information you give us

  • Account information: name, email address, and password (stored only as a salted hash) when you sign up.
  • Listing information: photos, location, asking price, fuel-volume history, financial documents, tax returns, and UST or environmental compliance disclosures uploaded by sellers.
  • NDA records: the time you signed a per-listing NDA, the listing it relates to, and the version of the NDA you accepted.
  • Messages and LOIs: the content of conversations and offers you exchange with the other party in a deal.
  • Closing-room contributions: tasks, status updates, and documents shared with closers (brokers, attorneys, accountants).

1.2 Information we collect automatically

  • Log data: IP address, browser type, pages visited, and timestamps. Used for security, abuse prevention, and basic analytics.
  • Cookies and session data: a single secure, HttpOnly session cookie keeps you signed in. We do not use third-party advertising cookies.

1.3 Information from third parties

  • Payment processor: when you pay the listing fee, our processor confirms the charge succeeded and returns an obfuscated reference. We do not see or store your full card number.
  • Email delivery: our transactional email provider reports delivery, bounce, and unsubscribe events for the notifications we send.

2. How we use information

We use the information described above to:

  • operate, maintain, and secure the marketplace;
  • let buyers discover listings and sellers respond to inquiries;
  • enforce per-listing NDAs and produce an audit trail of who saw what;
  • send transactional emails (account confirmations, NDA signatures, new messages, LOI updates);
  • investigate fraud, abuse, or violations of the Terms & Conditions;
  • comply with legal obligations and respond to lawful requests.

We do not sell personal information, and we do not share it with advertising networks or data brokers.

3. The NDA gate

Documents that sellers mark as gated (tax returns, P&L, UST and environmental records, and similar) are visible only to buyers who have signed the per-listing NDA for that listing. The seller can see which buyers have signed and what those buyers have viewed. Octaned retains these access logs as part of the audit record.

4. Sharing

We share information only as described below:

  • With the other party in a deal: sellers see who signed their NDA; buyers and sellers see each other's messages and LOIs; closers invited into a closing room see what the inviting party shares with them.
  • With service providers: infrastructure (cloud hosting), payment processing, and email delivery vendors who process data on our behalf under written agreements.
  • For legal reasons: in response to subpoenas, court orders, or government requests, or to protect our rights and the safety of users.
  • In a corporate transaction: if Octaned is acquired, merged, or sold, your information may transfer subject to this policy or a successor policy with materially similar terms.

5. Security

We use industry-standard practices to protect data, including TLS-encrypted transport, encrypted database storage, salted password hashing, signed session cookies, and isolation of NDA-gated documents. No system is perfectly secure, however; you use the platform at your own risk and should not upload information you cannot afford to disclose.

6. Data retention

We keep account data and listing data for as long as your account is active. After deletion, we may retain minimum records (NDA acceptance logs, payment receipts, and aggregated analytics) for legal and audit purposes for up to seven years.

7. Your choices

  • Access & correction: you can review and update most account information from your dashboard.
  • Deletion: request account deletion by emailing privacy@octaned.us. Some records may be retained as described in section 6.
  • Email preferences: transactional emails (NDA signatures, messages, LOIs) cannot be turned off without deactivating your account, because they are essential to the service. Marketing emails, where applicable, include an unsubscribe link.
  • Cookies: you can clear or block cookies in your browser settings, but doing so will sign you out and may break parts of the platform.

8. Children

The platform is not directed at children under 18 and we do not knowingly collect information from them.

9. International users

Octaned is operated in the United States and your information may be processed there. If you access the platform from outside the U.S., you consent to that processing.

10. Changes

We may update this policy. Material changes will be posted here with a new “Last updated” date and, where appropriate, announced via email.
